If you do not agree with any of these Terms, you must immediately cease use of the website and services. 1.2. Eligibility: By using this site, you confirm you are at least the age of majority in your state or province of residence, or that you are the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

2. Product Information and Accuracy

2.1. Natural Variation: Given that we deal with natural materials, including gemstones and precious metals, minor variations in size, colour, clarity, and dimensions are inherent and expected. While we strive for accuracy, such variations are not considered defects. 2.2. Measurements: All weights (e.g., carat weight) and measurements are approximate. 2.3. Pricing: Prices for our products are subject to change without notice. We reserve the right to correct any errors or inaccuracies in pricing or information at any time.

 

3. Orders, Production, and Payment

3.1. Order Acceptance: Your receipt of an electronic or other form of order confirmation does not signify our final acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. 3.2. Made-to-Order: Many of our pieces are handcrafted and made-to-order. Production begins only after your order is confirmed and payment is received. You acknowledge and agree to the specified production lead times provided at the time of purchase. 3.3. Payment: We use third-party payment processors (e.g., Stripe, Klarna) to handle all transactions. Your payment information is subject to the terms and conditions of these third-party processors.

 

4. Shipping, Delivery, and Risk of Loss

4.1. Shipping Times: Any shipping or delivery dates provided are estimates only. 4.2. Risk of Loss: The risk of loss or damage to your purchased item passes to you upon delivery or when the goods are physically transferred to your possession or the possession of a designated representative. We ensure all shipments are tracked and insured up to the point of delivery.

 

5. Warranties and Returns (Australian Consumer Law)

5.1. Statutory Guarantees: Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms limits, excludes, or modifies any consumer guarantees or warranties conferred by the ACL. 5.2. Warranty Policy: Details regarding our Lifetime Manufacturing Warranty, 1-year Fine Jewellery Warranty, and conditions for coverage are set out in our separate Warranty and Australian Consumer Guarantees policy, which is incorporated into these Terms by reference. 5.3. Returns and Exchanges: Details regarding returns, including the 14-day minimum return window, eligibility for change of mind, return shipping costs, and the required return address, are set out in our separate Returns & Exchanges Policy, which is incorporated into these Terms by reference.

 

6. Limitation of Liability

To the maximum extent permitted by Australian law, Humphrey Jewellery shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from your use of the service or any products procured using the service. Our total liability to you for any claim arising out of these Terms or your use of the website is limited to the amount paid by you for the product giving rise to the claim.

 

7. Intellectual Property

All content on this site (including text, graphics, logos, images, product designs, and software) is the property of Humphrey Jewellery and is protected by Australian and international copyright and intellectual property laws. You may not reproduce, duplicate, copy, or exploit any portion of the content without express written permission.

 

8. Governing Law

These Terms and any separate agreements whereby we provide you services shall be governed by and construed in accordance with the laws of the State of  Victoria, Australia.
